You've found your home for pickleball, Pilates, and everything in between — a premium 24/7 destination in the heart of the BRiC, designed to blend community, wellness, and modern coastal style. We're thrilled to have you with us.

Before your first rally, please review this Agreement carefully. By tapping “Accept & Sign” at the bottom, you acknowledge that you understand and agree to all terms below.

Section 01

Assumption of Risk & Physical Condition

I acknowledge that participating in pickleball, Pilates, group fitness, or related activities involves inherent risks, including but not limited to slips, falls, collisions, equipment failure, physical exertion, or other unforeseen hazards. These risks may result in injury, property damage, or, in extreme cases, sudden death due to negligence or underlying medical conditions.

I voluntarily choose to participate and fully accept all such risks.

I affirm that I am in good physical condition and capable of safely engaging in physical activity. I agree to notify The Palms Indoor Pickleball of any health condition that may affect my ability to participate safely.

Section 02

Release of Liability & Indemnification

In consideration of being allowed to participate in activities or use the facilities at The Palms Indoor Pickleball, I hereby release, waive, and discharge The Palms Indoor Pickleball, its owners, employees, instructors, contractors, agents, and affiliates from any and all liability for injury, loss, or damage to person or property, including those caused by ordinary negligence.

I agree not to sue The Palms Indoor Pickleball and to indemnify and hold harmless the released parties from any claims, demands, actions, or suits arising out of participation in activities or use of the facility.

Section 03

Emergency Medical Authorization

In the event of injury or medical emergency, I authorize The Palms Indoor Pickleball and its representatives to obtain emergency medical care or transport me to a medical facility.

I accept full financial responsibility for any medical treatment received and acknowledge that The Palms Indoor Pickleball does not provide medical insurance or coverage.

Section 04

Photo & Media Release

I grant permission to The Palms Indoor Pickleball to photograph and/or record video of me (or my minor child, if applicable) during participation and to use such images for promotional, marketing, and social media purposes without compensation.

If I do not wish to be photographed or recorded, I must opt out below and notify management in writing prior to participation.

Section 05

24/7 Access & Security Terms

The Palms Indoor Pickleball operates as a 24/7 facility. I understand that during non-staffed hours:

  • The facility is monitored by video surveillance for safety and security.
  • Access is limited to authorized members using assigned entry credentials (e.g., key fob, mobile access, or digital entry code).
  • I will not grant access to any unauthorized individual. Doing so may result in suspension or termination of membership.
  • I am responsible for my own safety and conduct while using the facility.
  • Staff may not be present to supervise play or provide assistance.
  • The individual booking the reservation is solely responsible and assumes full responsibility for all guests they allow entry, including ensuring each person has a completed waiver and paid access to the facility. Any unauthorized entry is at the sole risk and liability of the booking party.
  • In the event of an emergency, I will call 911 immediately and notify management as soon as reasonably possible.
Section 06

Code of Conduct

To maintain a positive, safe, and respectful environment, all players, guests, and spectators agree to:

  • Treat others, staff, and the facility with respect at all times.
  • Refrain from harassment, profanity, or aggressive behavior (verbal or physical).
  • Wear appropriate athletic attire and non-marking court shoes. Open-toed shoes, boots, or leather-soled shoes are prohibited. Shirts and appropriate clothing are required at all times.
  • Keep courts clean and safe. Only water is permitted on courts; food and other beverages must remain off-court.
  • Use equipment properly and report damage, spills, or unsafe conditions immediately.
  • Prioritize safety by stopping play when necessary and calling out “Ball on!”
  • Follow all facility rules, including prohibitions on smoking, vaping, and unauthorized instruction or coaching.
  • Demonstrate good sportsmanship, fairness, and courtesy at all times.

Strict Policy: Players who register or rent a court shall be deemed strictly liable for the conduct of their guests. All guests must adhere to The Palms policies, including mandatory sign-in procedures and executed waivers. Unauthorized or unregistered guest access is prohibited and will subject the registering player to disciplinary measures and fines.

Failure to comply with this Code of Conduct may result in suspension or removal from the facility without refund.

Section 07

Personal Ball Machines & Equipment Responsibility

Participants who bring and use their own ball machines or personal training equipment do so entirely at their own risk.

The Palms Indoor Pickleball assumes no responsibility or liability for the operation, malfunction, damage, theft, or loss of any personal equipment.

I agree to be solely responsible for any damage caused to courts, playing surfaces, nets, walls, fencing, equipment, or facility property resulting from the use of personal equipment and agree to reimburse The Palms Indoor Pickleball for all repair or replacement costs.

The Palms Indoor Pickleball reserves the right to restrict or prohibit the use of any personal equipment that may pose a safety risk or risk of damage to the facility.

Section 08

Minor Participant — Parent / Legal Guardian Consent

If the participant is under eighteen (18) years of age, the parent or legal guardian accepting this Agreement acknowledges and agrees:

  • I am the parent or legal guardian of the minor participant and have legal authority to accept this Agreement on the minor's behalf.
  • I consent to the minor's participation and understand the inherent risks involved.
  • All terms of this Agreement apply fully to the minor participant.
  • I assume full responsibility for the minor's supervision, conduct, and compliance with facility rules.
  • I release, waive, and agree to indemnify and hold harmless The Palms Indoor Pickleball and its affiliates from any claims arising from the minor's participation, including those resulting from ordinary negligence.
  • Any medical insurance coverage for the minor is my sole responsibility.

I acknowledge that I have read, understood, and voluntarily agreed to all terms of this Liability Waiver, Assumption of Risk, Photo & Media Release, 24/7 Access & Security Terms, Equipment Responsibility, and Code of Conduct. I certify that I am at least eighteen (18) years of age, or that I am the parent or legal guardian of the minor participant and have authority to accept this Agreement on their behalf. I understand that this Agreement is governed by the laws of the State of Florida and applies to all current and future visits to The Palms Indoor Pickleball unless revoked in writing.
